Walmart Sues Tesla in New York State Supreme Court After Electric Vehicle Manufacturer’s Solar Panels Set Fire to Seven Retailer-Owned Retail Stores.
Walmart alleges breach of contract, gross negligence and non-compliance with industry standards in its lawsuit. Walmart asks Tesla to remove solar panels from more than 240 Walmart stores where they were installed and pay damages for all fires Walmart says were caused by Tesla devices.
The retailer said fires broke out on the rooftops of seven stores between 2012 and 2018, causing millions of dollars in damage..
Walmart stated that «Tesla regularly dispatches people to test solar systems who lack basic solar training and knowledge». The lawsuit also alleges that Tesla was unable to properly ground its solar and electrical systems, and that installed solar panels in Walmart stores contained a large number of defects that were visible to the naked eye, and that Tesla had to find and fix before they brought to fires.
Last May, Walmart said it had demanded Tesla shut down any solar panel systems it had installed. But Walmart said another fire still occurred in a California store, although the panels were off for months. The company said the store’s rooftop wires were still sparkling when it discovered the fire.
Walmart said it later found out that Tesla had ignored the store’s solar warning, which Walmart said was the likely cause of the fire. Walmart’s legal action indicated that ignoring the warning would reveal «Tesla’s complete incompetence, or callousness, or both».
Walmart Inc. did not indicate how much money she was asking Tesla for, saying that the amount would be determined in court proceedings.
